Motion Creative Cloud Inc. (“Motion”, “we”, or “us”) values and respects your privacy. We have prepared this privacy policy to explain the manner in which we collect, use and disclose personal information when you use our online shopping behaviour tracking and targeted advertising services available to our clients (“Clients”) through projects.motionapp.com (the “Motion Solution”), visit our website located at https://motionapp.com/ (the “Website”), engage with us on social media, and otherwise interact with us. In order to provide the services, we collect certain information from our Client’s customers (“Customers”).

1. Collection and Use of Personal Information

Motion collects and uses personal information primarily on behalf of and in the course of providing services to our Clients. In certain limited contexts, we may collect personal information on our own behalf, such as in connection with visits to our Website, job applications, and to send marketing communications.

How we collect and use personal information on behalf of our Clients

Provision of Motion Solution: In order to provide the services through the Motion Solution, we collect information about our Client’s Customers’ and their engagement with targeted advertising services deployed by our Clients. In addition, with our Client’s consent and on behalf of our Client, we may obtain information about Client’s Customers from third party organizations.  We require our Clients to provide appropriate notice and ensure that they have obtained all necessary authority or consent to provide or enable us to collect personal information on their behalf in accordance with applicable privacy laws. Except as set out herein, we do not collect or use personal information from our Clients for any purpose other than to provide services on behalf of our Clients. We do not actively collect personal information of Customers for the purpose of sale or marketing in a way that specifically identifies the individual.

We provide services to our Clients through the following ways:

Statistics: We collect data on behalf of our Clients about their Customer’s interaction with the Client’s targeted advertising This information enables our Clients to understand engagement with specific products. We may use and share this data in an aggregated statistical form for our own purposes.   

Use of the Motion Solution: We may monitor use of the Motion Solution by our Clients or other authorized users in order to detect, investigate or prevent any actual or potential violation of our terms and conditions. We may also generate aggregated, non-identifiable data and use such information to improve the Motion Solution and monitor the performance, use and stability of the Motion Solution.

How we collect and use personal information through the use of the Motion Solution, Website, and in other interactions with you

We may collect personal information when you:

  • Create an account 
  • Purchase a plan 
  • Sign-up to receive marketing emails such as newsletters, offers and promotions
  • Engage with Motion through social media
  • Enter a contest or participate in a promotion

Visiting the Website: You do not have to register to visit or use our Website. However, we do collect some personal information when you visit our Website. Please see "Information about our Website," below, for detailed information regarding the personal information we collect when you visit and use our Website, and the choices you have with regards to that collection. 

Create an Account: If you create an account to use the Motion Solution, you will be required to provide personal information including, but not limited to, your first and last name, your title, email address, profile picture, information about your organization, and a password that you create. We use this information to create and administer your account. We strongly recommend that you do not disclose your password to anyone. We will never ask you for your password in any unsolicited communication (such as letters, phone calls or email messages). If you become aware of any unauthorized access to or use of your account, you are required to notify us immediately.

Purchasing a Plan: If you purchase a subscription to one of our plans, we (or our authorized third-party payment processor) will collect information such as your first and last name, email address, phone number, mailing address, delivery address, and your payment information (including billing address, credit card number, expiry date and CVV/CVC code) in order to process your payment.  

Marketing Communications: If you sign up to receive email marketing communications, we will collect your email address in order to send you newsletters, offers, promotions, and the latest updates that may be tailored to your interests and preferences. You can unsubscribe at any time by clicking the “unsubscribe” link included at the bottom of each email. Please note that you may continue to receive transactional or account-related communications from us.

Contests and Promotions: When you enter a contest or participate in a promotion, we may collect your name, address, email address, phone number, and any additional information or content required for the contest or promotion, including to deliver a prize to you. We use this information to administer your participation in the contest or promotion.

Employment: In connection with a job application or related inquiry, you may provide us with certain personal information about yourself (such as that contained in a resume, cover letter, or similar employment-related materials). We use this information for the purpose of processing and responding to your application for current and future career opportunities.

Become a Partner: If you choose to join our partner program, we may collect your first and last name, email address, title, business name, country, city, and other information about your organization. We use this information in order to assess your suitability as our partner. 

Surveys: From time to time, we may offer you the opportunity to participate in one of our surveys. We use this information to help us understand our users and to enhance our Website.

Social Media Sites: If you engage with us on our social media pages, we collect the information you post or send to us and use it to better understand our customers and respond to you. You should use caution before posting or providing any personal information on public sites.

Contact Us: When you contact us using one of our channels (chatbot, Slack, telephone or email) with a comment, question or complaint you may be asked for information that identifies you, such as your name and email address, along with additional information we need to help us promptly answer your question or respond to your comment.  We may retain this information to assist you in the future and to improve our customer service and products.

2. Sharing of Personal Information

We do not sell or disclose your personal information to third parties without your consent, except as set forth below or as required or permitted by law.

Service Providers: Your personal information will be transferred (or otherwise made available) to certain third parties that provide services on our behalf. We use service providers to provide services such as hosting the Website, processing payments, providing support services, conducting sales, administering user accounts, enabling us to provide the services, facilitating employment opportunities, and providing advertising, analytics and marketing services. Our service providers are only provided with the information they need to perform their designated functions and are not authorized to use or disclose personal information for their own marketing or other purposes. Our service providers may be located in the U.S., Canada or other foreign jurisdictions.

Legal and Compliance: We and our Canadian, US and other foreign service providers may provide your personal information in response to a search warrant to other legally valid inquiry or order, or to another organization for the purposes of investigating a breach of an agreement or contravention of law or detecting, suppressing or preventing fraud, or as otherwise may be required or permitted by applicable Canadian, U.S. or other law or legal process, which may include lawful access by US or foreign courts, law enforcement or other government authorities. Your personal information may also be disclosed where necessary for the establishment, exercise or defence of legal claims and to investigate or prevent actual or suspected loss or harm to persons or property. Where a disclosure of our Clients’ information is required by applicable law, we promptly notify our Client prior to complying with such requirements (to the extent we are not prohibited from doing so) and fully co-operate with our Client’s instructions with respect to our response.

Sale of Business: We may transfer any information we have about you as an asset in connection with a proposed or completed merger, acquisition or sale (including transfers made as part of insolvency or bankruptcy proceedings) involving all or part of & Motion or as part of a corporate reorganization or other change in corporate control.

3. Information About Our Website

Visiting our Website:  In general, you can visit our Website without telling us who you are or submitting any personal information. However, we collect the IP (Internet protocol) addresses of all visitors to our Website and other related information such as page requests, browser type, operating system and average time spent on our Website. We use this information to help us understand our Website activity and to monitor and improve our Website.

Cookies:  Our Website uses a technology called "cookies". A cookie is a tiny element of data that our Website sends to a user’s browser, which may then be stored on the user’s hard drive so that we can recognize the user’s computer or device when they return. You may set your browser to notify you when you receive a cookie or to not accept certain cookies. However, if you decide not to accept cookies from our Website, you may not be able to take advantage of all of the Website features.

Analytics: We may use a third-party such as Google Analytics to help us gather and analyze information about the areas visited on the Website (such as the pages most read, time spent, search terms and other engagement data) in order to evaluate and improve the user experience and the Website. Third-Party Links:  Our Website may contain links to other websites that Motion does not own or operate. We provide links to third-party websites as a convenience to the user. These links are not intended as an endorsement of or referral to the linked websites. The linked websites have separate and independent privacy policies, notices and terms of use. We do not have any control over such websites, and therefore we have no responsibility or liability for the manner in which the organizations that operate such linked websites may collect, use or disclose, secure and otherwise treat personal information. We encourage you to read the privacy policy of every website you visit.

4. Interest-Based Advertising

We work with third parties such as ad networks and other advertising companies that use their own tracking technologies (including cookies and pixel tags) on our Website in order to provide you with tailored advertisements across the Internet. These companies may collect information about your activity on our Website and third-party websites (such as web pages you visit and your interaction with our advertising and other communications) and use this information to make predictions about your preferences, develop personalized content and deliver ads that are more relevant to you on third-party websites. This information may also be used to evaluate the effectiveness of our online advertising campaigns.

Please note that even if you opt-out of interest-based advertising by a third-party, these tracking technologies may still collect data for other purposes including analytics and you will still see ads from us, but the ads will not be targeted based on behavioural information about you and may therefore be less relevant to you and your interests. 

To successfully opt out, you must have cookies enabled in your web browser (see your browser’s instructions for information on cookies and how to enable them). Your opt-out only applies to the web browser you use so you must opt-out of each web browser on each computer you use. Once you opt out, if you delete your browser’s saved cookies, you will need to opt-out again.

5. Safeguards and Retention

We have implemented reasonable administrative, technical and physical measures in an effort to safeguard the personal information in our custody and control against theft, loss and unauthorized access, use, modification and disclosure. We restrict access to personal information on a need-to-know basis to employees and authorized service providers who require access to fulfil their job requirements.

We have record retention processes designed to retain personal information for no longer than necessary for the purposes set out herein or as otherwise required to meet legal or business requirements. We may retain certain data as necessary to prevent fraud or future abuse, or for  analysis of aggregated, non personally-identifiable data, account recovery, or if required by law. All retained personal information will remain subject to the terms of this privacy policy.

As indicated above, if you have signed-up to receive our email communications, you can unsubscribe any time by clicking the “unsubscribe” link included at the bottom of the email. To opt-out of interest-based advertising, see the “Interest-Based Advertising” section above. Please note that you may continue to receive transactional or account-related communications from us. 

7. Your Rights

If we receive a request from an individual to access or update personal information we maintain on behalf of a Client, we will direct that individual to the relevant Client. We will assist our Clients wherever possible in responding to individual access requests.

Subject to applicable law, you may request access to or correction of personal information in our custody or control. You may make a request by emailing or writing to us at the contact information set out below. We may request certain personal information for the purpose of verifying the identity of the individual seeking access to his or her personal information records.

8. Updates to the Privacy Policy

We may update this privacy policy periodically to reflect changes to our privacy practices. We encourage you to periodically review this page to ensure you are familiar with those changes. Any non-material change (such as clarifications) to this privacy policy will become effective on the date the change is posted and any material changes will become effective 30 days from their posting on this Website. We will indicate at the top of this privacy policy when it was most recently updated.
